2 01.05.2026 1) None appears on behalf of the petitioner even when the case is taken up for hearing in the second round. 2) By way of this petition, petitioner has sought following reliefs:-
“10.1 That this Hon'ble Court may kindly be pleased to direct the respondent authorities to call the entire records pertaining to this case. 10.2 The Hon'ble Court may kindly be pleased to issue writ in the nature of mandamus/prohibition/certiorari, thereby to set aside the impugned order dated 28-10-2021 and memo dated 08-11-2021 after declaring it to be unconstitutional, illegal and arbitrary. 10.3 The Hon'ble court may kindly further be pleased to direct the respondent authorities to consider claim of compassionate appointment of the petitioner from the date, ordinarily she deserved for, and further to pass any other relief(s) which it deems fit along with cost of the petition in the interest of justice.” 3) It is pleaded that the husband of the petitioner died on 4.3.2015, who was working on the post of Shiksha Karmi Grade-II. The petitioner, being the wife of the deceased employee, moved an application for grant of compassionate appointment on 19.5.2015. When no heed was paid, the petitioner filed WP(S) No.4170 of 2018, which was disposed of vide order dated 23.9.2021 wherein a direction was issued to the respondent authorities to take a decision within a period of 90 days. The application of the petitioner was rejected by the Chief Executive Officer, Zilla Panchayat, Bilaspur vide order dated 28.10.2021 on the ground
3 that the petitioner failed to acquire the requisite qualification for the post of Shiksha Karmi Grade-III. 4) Learned counsel appearing for the respondents would submit that the petitioner was not eligible for the post of Shiksha Karmi Grade-III and has failed to acquire the required qualification, therefore, the application was rejected by respondent No.4. They would contend that the petition deserves to be dismissed. 5) I have heard learned counsel for the parties and perused the documents placed on record. 6) The husband of the petitioner was appointed to the post of Shiksha Karmi Grade-II. He died in harness on 4.3.2015 and his wife moved an application for grant of compassionate appointment. The claim of the petitioner has been rejected on the ground that she did not possess the requisite qualification.
7) The services of the Assistant Teacher (Panchayat) were absorbed with the School Education Department pursuant to a notification issued on 30.06.2018 and at currently posts of Shiksha Karmis are not available with the department. The petitioner could not acquire required qualification for the post of Shiksha Karmi Grade-III; therefore, she has not been considered for grant of compassionate appointment, but the fact remains that the posts of Shiksha Karmis are not available with the department; therefore, no such appointment can be provided to the petitioner, even she possesses the requisite qualification. 4 8) Looking at the facts discussed above, a decision was taken by the State Government and a committee was constituted by the General Administration Department to resolve the dispute. It appears that till date no decision has been taken; therefore, at this juncture, the petition is disposed of with a direction to the Committee constituted to resolve the dispute involved in the petition within a period of 60 days from the date of receipt of a copy of this order. 9) The respondent authorities may consider the claim of petitioner for appointment against Class IV posts. 10)With the aforesaid observation(s), and direction(s), this petition is
