This writ petition has been filed alleging inaction on the part of the concerned Sub- Divisional Officer, Ghatal, in failing to take appropriate steps pursuant to a reference made by the Pradhan of Nandanpur-II Gram Panchayat under Section 23(5) of the West Bengal Panchayat Act, 1973. Learned counsel appearing on behalf of the petitioner submits that the Sub-Divisional Officer, Ghatal, has already initiated proceedings under Section 23(5) of the West Bengal Panchayat Act, 2 1973 concerning the alleged unauthorised construction undertaken by respondent no. 10. In view of the aforesaid submission, no useful purpose would be served by keeping the writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Sub-Divisional Officer, Ghatal, to conclude the proceedings, after affording an opportunity of hearing to all concerned parties, preferably within a period of three months from the date of communication of this order. WPA 29732 of 2025 is, thus, disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings. (Kausik Chanda, J.)
