The applicant has preferred this First Bail Application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 128/2025 registered at Police Station – Lailunga, District- Raigarh (C.G.) for the offence punishable under Sections 20(B), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. Learned State counsel pointed out that the bail application of the applicant had earlier been rejected on 27.11.2025 by the trial Court RAHUL DEWANGAN Digitally signed by RAHUL DEWANGAN 2 in respect of the offences under Sections 20(B) and 29 of the NDPS Act and Section 111 of the Bharatiya Nyaya Sanhita, 2023, and further submitted that the charge-sheet has since been filed against the present applicant for the said offences as well as for the offence under Section 335(1) of the B.N.S. However, it was also pointed out that there was no specific rejection of bail in respect of the offence under Section 335(1) of the B.N.S. and that the present bail application does not contain complete particulars. 3. In view of the above, learned counsel for the applicant sought permission of this Court to withdraw the present bail application with liberty to file a fresh application including the said offence. 4. Permission is granted. 5. Accordingly, the present bail application is dismissed as withdrawn with the aforesaid liberty. 6.
