Learned Additional Government Advocates takes notice for all the respondents.

It is the contention of the petitioner that he has filed an application in Form No.50 on 15.07.1991 and again on 03.12.1998, the petitioner has filed an application in Form No.53 seeking regularization of unauthorized occupation of 2.00 Acres of land in Survey No.30 of Sadenahalli Village, Hesaraghatta Hobli, Yelahanka Taluk, Bengaluru North Taluk and till date the applications have not been taken up and no orders are passed.

Learned Counsel for the petitioner has drawn the attention of this Court to the Annexures filed along with memorandum of writ petition and contends that consequent to the application filed by the petitioner, his statement has been recorded by the Revenue Department Officials along with Mahazar. The sketch has also been prepared by the competent authority. Nevertheless, no further action has been taken.

Having regard to the contentions raised in the writ petition and submissions of the learned Counsel for the petitioner, this Court is of the considered opinion that respondent-Tahsildar was duty bound to place the application filed by the petitioner in Form No.50 and Form No.53 before the Committee for Regularization of Unauthorized Occupation and the Committee was also duty bound to consider the application and pass necessary orders. That exercise not has been taken by the respondent-authorities till date.

5. Consequently, the writ petition stands
disposed of with a specific direction to respondent No.3- Tahsildar, Yalahanka Taluk to verify from the records as to whether such applications filed by the petitioner in Form No.50 as well as Form No.53 in the year 1991 and 1998, are pending consideration. If it is found that such applications were indeed filed by the petitioner and the applications are yet to be considered, the respondent- Tahsildar is directed to place the application along with his recommendation before the Deputy Commissioner, who is the competent authority to consider the application in respect of properties falling within the jurisdiction of Bangalore Urban District, within a period of 4 weeks from the date of receipt of a copy of this order. Thereafter, the Deputy Commissioner shall pass necessary orders on the application as expeditiously as possible and at any rate within a period of 2 months from the date when the application would be placed before the Deputy Commissioner.

6. Needless to observe that till a final decision is taken by the Committee, the possession of the petitioner shall not be disturbed.
7. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
