The concern raised in this Public Interest Litigation Petition is in respect of Tikri Kalan Khampur Wholesale Market Complex which is to be set up especially for the benefit of the farmers. 3. The prayers made in this writ petition are that: (i) Request for proposal for consultancy services, 02.01.2026 be quashed, (ii) Respondents be directed to give details of the public fund spent on earlier consultancy and architectural services hired by respondent no.3, (iii) To direct a comprehensive technical and financial audit and fix the responsibility and further to impose exemplary costs for alleged defiance of order dated 11.02.2020, passed by a Coordinate Bench of this Court in W.P.(C) 2011/2018. 4. The Order is downloaded from the DHC Server on 08/07/2026 at 12:26:46 find is that the primary grievance raised in the petition is that despite directions of this Court issued way back in the year 2020, the said Market Complex has yet not been constructed though, in the meantime, various attempts have been made by respondent no.3 by making efforts to engage consultancy and architectural services. 5. The Coordinate Bench of this Court while deciding W.P.(C) 2011/2018 has already observed that building plan for the modern fruit and vegetable market at Tikri Kalan Khampur, New Delhi has already been approved and while noticing the statement made on behalf of the respondent in the said proceedings that the construction would start soon on approval of the concerned respondent-authorities, the petition was disposed of by the Court. 6. Essentially, the prayers made in the instant writ petition appear to be the same, which were urged in W.P.(C) 2011/2018. In case, the directions issued by this Court in its order dated 11.02.2020 have not been complied with, the same in our considered opinion will not give rise to any fresh cause of action to the petitioner to approach the Court by instituting the proceedings of the instant writ petition. 7. At this juncture, the petitioner has stated that W.P.(C) 2011/2018 was not filed the petitioner rather by one Sh.Harpal Singh Rana. Be that as it may, in case, the order dated 11.02.2020 passed by this Court in W.P.(C) 2011/2018 has not been complied with, it is always open to the petitioner to institute appropriate contempt proceedings, for the reason that contempt proceedings can be instituted by a person who is not party before the Writ Court, especially, if the subject matter relates to public interest, such as the present one, where the concern of the petitioner is the construction of a fruit This is a digitally signed order.
