ORAL ORDER
1.
Learned counsel for the petitioner has filed a memo. Memo reads as under:
"The Accused/Petitioner above named most respectfully submits as follows:
1. The Accused/Petitioner is convicted under Section 138 of the Negotiable Instruments Act for the amount of Rs.1,00,000/- (One Lakh) in CC.No.5921/2013 on the file of the XVIII Addl. Chief Metropolitan Magistrate Bengaluru and the same was confirmed in Crl.Appeal. No.951/2016 on the file of the XLVII AddI. City Civil and Sessions Judge Bengaluru City.
2. The Accused/Petitioner, submits that without admitting the allegations in entirety, submits that he is willing to

settle the matter amicably in the interest of justice and to avoid further litigation.
3. The Accused/Petitioner submits that he undertakes to pay the cheque amount in Five (5) equal installments within a period of Five (5) months from today.
The Accused/Petitioner further undertakes to adhere strictly to the following schedule of payment:
(1) Installment: On or Before 22.05.2026 Rs.20,000/-
(2) Installment: On or Before 22.06.2026 Rs.20,000/-
(3) Installment: On or Before 22.07.2026 Rs.20,000/-
(4) Installment: On or Before 22.08.2026 Rs.20,000/-
(5) Installment: On or Before 22.09.2026 Rs.20,000/-
4. The Accused/Petitioner submits that in case of default in payment of any one of the instalments, the Complainant shall be at liberty to proceed in accordance with law.
WHEREFORE The petitioner above named humbly prays that this Hon'ble court be pleased to record this undertaking and grant time as prayed for, and dispose of the above Crl. Rev. Petition in Terms of the Memo for undertaking in the above case in the ends of Justice and equity."

2. None appears for the respondent.
3. Having noted the contents of memo, petitions can be disposed of which are pending from the year 2018 by placing the memo on record.
4. Hence, following order:
ORDER
(i) Criminal Revision Petitions are disposed off.
(ii) Amount in default is ordered to be withdrawn by the complainant under due identification.
(iii) It is made clear that if there is any default in payment of installments of compensation as agreed in the memo, petitioners shall undergo imprisonment as ordered by Trial Magistrate confirmed by the First Appellate Court.
