The petitioners are apprehending their arrest in connection with Dandai P.S. Case No. 102 of 2025, registered for the offence under Sections 196, 197, 299, 302, 353(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Section 67 of the Information and Technology Act, pending in the court of learned Judicial Magistrate, 1st Class, Garhwa. 3. Learned counsel appearing for the petitioners submits that the petitioners have only posted their views on the Facebook and the petitioners are having no intention to hurt the religious feeling of any community. He next submits that the petitioner No. 1 is a B.Tech student and petitioner No. 2 is a labourer. 4. Learned A.P.P appearing for the State has opposed the prayer and submits that the allegations are there against the petitioners of posting unpleasant post against the Deity. 5. Considering that the petitioners have only posted their views on the Facebook and further the petitioner No. 1 is a B.Tech student and petitioner No. 2 is a labourer and in that view of the matter, [2026:JHHC:4760] -2- the petitioners, named above, are directed to surrender before the learned Court within two weeks from today and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
