(2) Commandant, 31st Battalion, PAC, Rudrapur issued a notice to petitioner on 22.11.2025, asking her to vacate the residential accommodation. Careful perusal of the impugned notice reveals that residential accommodation was allotted to petitioner’s husband Constable Mahesh Bhatt, who has been dismissed from service. The date of dismissal is not indicated anywhere in the writ petition. Petitioner contends that she has two school going daughters and it is difficult for her to vacate the residential accommodation during winter, therefore she may be given some reasonable time so that she may find some alternative accommodation. (3) Learned State Counsel, however, submits that petitioner does not have any right to continue in the official accommodation, which was allotted to her husband, who has been dismissed from service long back. (4) This Court is not inclined to interfere with the impugned notice. However, having regard to peculiar facts and circumstances of the case, writ petition is disposed of by recording the undertaking given by Mr. Ketan Joshi, learned Counsel appearing for the petitioner, that petitioner will vacate the residential accommodation 2026:UHC:27 on or before 15th February, 2026. (5) In the event, petitioner fails to vacate the residential accommodation by 15th February 2026, the authorities shall be at liberty to have her forcibly dispossessed from the accommodation in question.
