Heard both the sides. The petitioner, above-named, who is in custody in connection with Mahila (Chatra) P.S. Case No. 24 of 2025 for the offence registered under Sections 64(1) / 351 (2) of BNS, 2023 and Sections 67(A) and 66(E) of the I.T. Act has moved for grant of regular bail. It is submitted by the learned counsel on behalf of petitioner that as per the case of prosecution, prosecutrix is a major girl, aged 24 years and had gone on the Motorcycle with the petitioner from Hunterganj, Chatra to Gaya, Bihar which is a distance of about 49 Km. It is alleged that she was forcibly seduced there in the Hotel and compromising photographs of her were also taken. It is argued that at no stage, she raised any protest nor resisted being taken to Gaya. It is submitted that the allegation as made in the FIR has been falsified. It is also submitted that allegation of the photographs having been made viral have also not been substantiated during investigation. It is submitted that the alleged incidence took place on 21.08.2025 whereas FIR has been lodged after an inordinate delay on 06.09.2025 without any explanation and petitioner is in custody since 06.09.2025. Learned S.P.P. opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
