It is an admitted position that the petitioner herein has filed a suit (Annexure-D to the writ petition), in which the private respondent no.4, Shri Bijender Kumar, as well as the respondent no.1/MCD, are parties, in which the relief claimed is also qua the illegal and unauthorized construction carried out by the private respondent no.4 on the subject property herein, i.e., Plot No. 29, Najafgarh Road, Moti Nagar, New Delhi -110015. 3.
