Order or Orders or Directions more particularly one in nature of Writ of Mandamus, declaring the action of the respondents in not providing appointment/employment to the petitioner under the displacement quota as per G.O.Ms.No.98, l and (PW) Department, dated 15.04.1986 despite the applications submitted on 16.07.2012 despite the lands acquired and award 39/87 passed dt.31.07.1987 as illegal, arbitrary, unconstitutional contrary to the orders passed in WP No. 2436/2011 dated 08.02.2011 (Division Bench) as confirmed by the Honble Supreme Court in SLP No. 14305/2011 dated 04.07.2011, apart from violative of article 14, 16, and 21 of the Constitution of India and consequently direct the respondents to provide the employment to the petitioner in accordance with the G.O.Ms.No.98, l and (PW) Department, dated 15.04.1986 and pass other order or orders as deem fit and proper according to the facts and circumstances of the case IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents to consider the case of the petitioner for employment under the displacement quota as per G.O.Ms.No.98, l&(PW) Department, dated 15.04.1986 as done in the similar situated persons pending disposal of the above Writ petition and in the interest of petitioner and pass such Counsel for the Petitioner:

ORDER:
The Writ Petition is filed questioning the action of the respondents in not providing appointment/employment to the petitioner under the displacement quota in accordance with G.O.Ms.No.98, Irrigation & P.W. Department, dated 15.04.1986, despite the petitioner having submitted applications on 16.07.2012, pursuant to the acquisition of the petitioner’s lands and passing of Award No.39/87, dated 31.07.1987, as illegal and arbitrary.

The case of the petitioner is that the petitioner’s village was submerged and his lands were acquired for the purpose of the Telugu Ganga Project, vide Award No.39/87, dated 31.07.1987, which was passed in the name of the petitioner’s father. It is his further case that, as per the scheme provided under G.O.Ms.No.98, dated 15.04.1986, the displaced persons are entitled to employment in the project under the rehabilitation and resettlement scheme. Pursuant thereto, the petitioner submitted an application dated 16.07.2012 before the competent authority seeking appointment/employment under the said scheme.

However, no orders have been passed on the said application till date. Hence, the present Writ Petition has been preferred.
3. Heard Sri Chukka Kranthi Kiran, learned counsel for the petitioner and learned Assistant Government Pleader for Services-III.

Learned counsel for the petitioner submits that the petitioner is the son of the original land owner whose lands were acquired for the Telugu Ganga Project and whose village was submerged on account of the said project. He submits that the petitioner made an application dated 16.07.2012 seeking employment under the displacement quota in terms of G.O.Ms.No.98, dated 15.04.1986, but the respondents have neither considered the said application nor passed any orders thereon. As such, prayed to pass appropriate orders directing the competent authorities to consider the case of the petitioner for employment.
5. The respondents have not filed any counter-affidavit opposing the averments made in the Writ Petition or disputing the factum of submission of the petitioner’s application dated

16.07.2012, which is stated to be pending consideration before the respondent authorities.

Having regard to the submissions made by the learned counsel for the petitioner and the material available on record, it is evident that the petitioner claims appointment under the displacement quota in terms of G.O.Ms.No.98, dated 15.04.1986, on the ground that his lands were acquired for the Telugu Ganga Project and that his application dated 16.07.2012, seeking such employment has not been considered by the respondent authorities.

Since the respondents have not filed any counter-affidavit disputing the pendency of the petitioner’s application, this Court, to meet the ends of justice, is inclined to direct the respondent authorities to consider the petitioner’s application and pass appropriate orders in accordance with G.O.Ms.No.98, dated 15.04.1986, considering his eligibility and entitlement prescribed thereunder.
8. Accordingly, the Writ Petition is disposed of, directing the respondent authorities to consider the application dated 16.07.2012 submitted by the petitioner for providing employment

under the displacement quota in terms of G.O.Ms.No.98, Irrigation & P.W. Department, dated 15.04.1986, and pass appropriate orders, after verifying the eligibility and entitlement of the petitioner, within a period of four (4) months from the date of receipt of a copy of this order. No costs.
As a sequel, interlocutory applications pending, if any, shall stand closed. ____________________________
