It is the case of the petitioner that the petitioner was given the charge of the post of Principal but he was removed on some allegation. He submits that he was not even noticed and the alleged enquiry was conducted behind the back of the petitioner. He lastly submits that order has been passed by the District Education Officer, Chatra and the enquiry was also conducted by the same person who passed the order of removal from the post of Principal. Thus, there is of element of biasness in the entire process, which prejudiced the petitioner. 3. Admittedly the petitioner was not made permanent Principal. He was only given the charge of the said post. Thus, the petitioner has got no right to remain in the said post. “In-charge Principal” is also not a substantive post. 2026:JHHC:1463 2 4. The other aspect is that the petitioner has been removed on the basis of some allegation. It is his case that allegation is also not correct and he was not given opportunity to defend himself. 5. Considering his submission, I direct the petitioner to file a representation before the Deputy Commissioner, Chatra. The Deputy Commissioner, Chatra after giving an opportunity of hearing to the petitioner should come to an independent conclusion without being influenced by the report of the District Education Officer, Chatra dated 20.10.2022. If the Deputy Commissioner comes to a finding that the allegation against the petitioner is not correct, appropriate corrective measures can be taken by the authorities. 6.
