Order 24/07/2026
1. The petitioners have preferred this bail application under Section 483 of BNSS in FIR No.104/2026 registered at Police Station Kanchanpur, District Dholpur for offences under Sections 189(2), 115(2), 126(2), 351(2), 352, 109(1) and 303(2) of BNS,
2023.
2. Heard, learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
3.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case. He submits that though the allegations levelled against the present petitioners of causing life-threatening injuries but their names do not find mention in the FIR and no specific overt act has been attributed to them. He further contends that no medical opinion is available on
[2026:RJ-JP:28646] (2 of 2) [CRLMB-11314/2026] record to establish that the injuries sustained by the injured were life-threatening. He again submits that co-accused Mahesh @Kalla has got benefit of bail by this Court on 06.07.2026. Petitioners are behind the bars since 27.04.2026 though one case has been reported against petitioner-Rajpal, however, in that case he is already on bail. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody and on the ground of parity with co- accused, the bail application deserves to be allowed.
4. Learned Public Prosecutor has vehemently opposed the bail application.
5. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioners but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.
6. Consequently, the bail applications under Section 483 B.N.S.S. are allowed and it is directed that the petitioners Rajpal S/o Chimman Singh and Bhola S/o Bhikam Singh, be released on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that each of them shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
