For the Informant : None …… ORAL ORDER IN COURT 10/04.02.2026 The Present Criminal Appeal has been filed under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act on behalf of the appellant for grant of anticipatory bail who is apprehending his arrest in connection with Dumka (M) P.S. Case No. 77 of 2021 for the offences under Sections 323, 341, 379, 504 and 34 of I.P.C. and Section 3(iii)(v) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act, which pending in the Court of learned Additional Session Judge-I-cum- 2026:JHHC:3299 2 Special Judge (SC/ST Act), Dumka. 2. As per FIR, the appellant alongwith Niwas Yadav are alleged to have abused and assaulted the Informant. It is alleged that Niwas Yadav has made construction on the land of the Informant, for that a complaint has been made before the Circle Officer and the Deputy Commissioner. 3. Learned counsel for the appellant has submitted that the appellant is innocent and has not committed any offence. It is submitted that the main dispute is between the Informant and one Niwas Yadav and the land belongs to the Informant and one Niwas Yadav and for which both were directed by the Circle Officer, Sadar Anchal to remain present with the records. It is submitted that the appellant is alleged to have abused the Informant and snatched the silver chain which is wholly incorrect. It is submitted that in view of the above, the appellant may be enlarged on anticipatory bail. 4. On the other hand, learned counsel for the State has raised objection the prayer for anticipatory bail of the appellant and submitted that offence has been committed under the Provisions of SC/ST Act and hence necessary order may be passed. 5. It reveals from the statements of the witnesses that the land is said to be in possession of Niwas Yadav and the appellant 2026:JHHC:3299 3 is alleged to have abused the Informant in name of his caste. 6. It appears from the statement of witnesses namely, Lakhinder Mohali, Vijay Mohali, Savitari Devi, Pradeep Hembrom at Paragraph- 6, 7, 8 and 9 respectively of the case diary that the main dispute is with regard to land between the Informant and one Niwas Yadav. 7. It also appears that snatching of chain of the Informant has not been supported by witnesses namely, Vijay Mohali, Pradeep Hemborm, Hari Kishan Singh and Manilal Yadav as recorded at Paragraph- 7, 9, 26 and 27 of the case diary. 8. Accordingly, the appellant namely, Shubham Singh @ Bhola Singh is directed to surrender before the learned Court below within a period of six (06) weeks from the date of this order and in the event of his surrender or arrest, the appellant namely, Shubham Singh @ Bhola Singh is directed to be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Session Judge-I-cum-Special Judge (SC/ST Act), Dumka or his/her Successor Court in connection with Dumka (M) P.S. Case No. 77 of 2021 subject to the conditions as laid down under Section 482 (2) of B.N.S.S. 9. The order dated 25.08.2023 passed by Sri Rakesh Kumar 2026:JHHC:3299 4 Mishra, learned Special Judge (SC/ST), Dumka in Anticipatory Bail Petition No. 63 of 2023, arising out of Dumka (M) P.S.
