26 Heard Mr. S.M. Abdullah P, learned counsel for the petitioners. Also heard Mr. M.P. Goswami, learned Additional P.P. for the State. Also heard Mr. G. Uddin, learned counsel for the respondent No.2. 2. This application under Section 482 of BNSS, 2023 has been filed by the petitioners, namely, (i) Abdul Mintu @ Abdul Mintu Ali and (ii) Abdul Rinku @ Rinku Ali who are apprehending their arrest in connection with Dibrugarh P.S. Case No. 103/2026, under Sections 112(2)/109(2)/3(5) of the BNS read with Section 25(1A) of the Arms Act. 3. The gist of accusation in this case is that on 11.04.2026, one Ijaz Ahmed had lodged an FIR before the Officer-in-charge of Dibrugarh Police Station, inter alia, alleging that on 11.04.2026 at about 10:30 AM when the first informant’s younger brother, namely, Abid Ali was going to shop for purchasing some household items, suddenly Abdul Mintu Ali, Rinku Ali, Sono Ali and Alfaz Ali started firing at him with pistol/revolver. As a result of which, the younger brother of the first informant sustained injuries on his left eye. It is further alleged in the FIR that later on some other persons including the present petitioner assaulted the first informant and his father when they reached at that place. 4. This Court by order dated 19.06.2026 granted interim protection to the petitioner No. (ii) namely, Abdul Rinku @ Rinku Ali and subsequently, by order dated 30.06.2026 the petitioner No.(i), namely, Abdul Mintu @ Abdul Mintu Ali was also granted interim pre-arrest bail. 5.
On perusal of the case diary, it appears that principal allegation is against the
Page No.# 3/3 petitioner No.(i), namely, Abdul Mintu @ Abdul Mintu Ali, who is presently in custody in connection with a subsequent case registered against him. 6. From the materials available in the case diary, no direct role is attributed to the petitioner No. (ii) namely, Abdul Rinku @ Rinku Ali in the act of firing and injuring the victim. 7. Learned counsel for the petitioners submits that he does not press this application in respect of petitioner No.(i), namely, Abdul Mintu @ Abdul Mintu Ali. 8. Having regard to the above, the prayer for pre-arrest bail in respect of petitioner No. (ii) namely, Abdul Rinku @ Rinku Ali is allowed and the order of interim pre-arrest bail dated 19.06.2026 granted in favour of petitioner No. (ii) namely, Abdul Rinku @ Rinku Ali is hereby made absolute on the same terms and conditions. 9. The order of interim bail dated 30.06.2026 in respect of petitioner No.(i), namely, Abdul Mintu @ Abdul Mintu Ali is hereby vacated/stands recalled. 10.
