1. Petitioner participated in the selection process for being appointed as Constable (G.D.) under Central Armed Police Forces (for short, ‘CAPFs’). In Physical Standard Test (PST) height of the petitioner was assessed less than the requisite height, i.e., 170 cm. Thereafter, petitioner preferred appeal before the concerned authority but the grievance of the petitioner is that appeal is yet to be decided.
2. Respondents are represented by learned advocate who has submitted that the Board which was constituted to decide the appeals is no more in existence. It is also submitted that concerned respondent authorities may be directed to decide the appeal of the petitioner.
3. From the submissions made on behalf of the parties, it appears that the Board constituted for the selection process is no more in existence and
the appeal preferred by the petitioner questioning measurement of height, is till date not disposed of.
4. Hence, Inspector General, Central Reserve Police Forces, Head Quarters, Kolkata being respondent no. 7 is directed to decide the appeal of the petitioner relating to height by four (4) weeks from the date of communication of this order. Decision to be taken by the respondent no.7 shall be communicated to the petitioner by seven (7) days thereafter.
5. However, it is clarified that in the event petitioner’s height is found to be within the prescribed limit, consequential steps shall be taken for
consideration of candidature of the petitioner for being appointed against the post of Constable (G.D.) under CAPFs.
6. With the above directions, writ petition stands
disposed of.
7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (Saugata Bhattacharyya, J.) 2
