1. Heard Mr. Karhale, learned counsel appearing for the Applicant and Mr. Jadhav, learned APP appearing for the State. 2. By this application filed under Section 482 of the Bharatiya Nyaya Sanhita, 2023, the Applicant is seeking pre-arrest bail in connection with C.R. No. 315 of 2026 registered with Ambegaon Police Station, Pune City for the offences punishable under Sections 318(4), 336(3), 338, 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 82 of the Registration Act, 1908. 3. As per the prosecution case, the Applicant and the co- accused had registered Sale Deeds by annexing the 22nd September, 2026
921 ABA-2627-2026.DOC skt Commencement Certificates, Development Permissions and Occupancy Certificates allegedly issued by the Pune Municipal Corporation and the said documents are forged and fabricated. 4. As per the prosecution case, Village Nanded, Taluka Haveli, came within the jurisdiction of the Pune Municipal Corporation only in the year 2021. However, some of the documents are purported to have been issued by the Pune Municipal Corporation in the year 2016, at a time when the Pune Municipal Corporation was not concerned with or had no authority to grant permission for construction in the said village. 5. However, it is the submission of learned counsel appearing for the Applicant that Applicant’s parents are the owners of the subject property which is situated at Grampanchayat Nanded, Taluka Haveli, District Pune and they executed the Development Agreement dated 27th April 2018 in favour of M/s. Mauli Constructions and have executed a Power of Attorney in favour of Mr. Sharad Mahadeo Matale, Partner of M/s. Mauli Constructions. He submits that there is a further Memorandum of Understanding dated 28th October 2020 executed between the parents of the Petitioner and said M/s. Mauli Constructions which is concerning distribution of profit in the said development scheme.

921 ABA-2627-2026.DOC skt that her mother passed away on 12th October 2024 and therefore the Applicant and her siblings have executed power of attorney in favour of their father. He submits that therefore the Applicant is not involved in the crime. There are no other antecedents. He submits that the Applicant is a school teacher and is having a daughter of ten years. 6. Mr. Jadhav, learned APP submits that the offence is of a serious nature as it involves the creation of fabricated documents, and therefore, anticipatory bail be not granted to the Applicant. 7. Perusal of the record shows that the parents of the present Applicant are the owners of the subject property. They executed the registered Development Agreement in the year 2018 with the Developer namely M/s. Mauli Constructions and thereafter in the year 2020 executed a Memorandum of Understanding regarding profit-share. The mother of the Applicant passed away on 12th October 2022 and therefore as the Applicant and her siblings, who are the co-sharers in the said property of their mother, in that capacity, they executed a Power of Attorney dated 30th June 2025 22nd September, 2026
921 ABA-2627-2026.DOC skt in favour of their father. Prima facie the Applicant is not involved in the crime. 8. Accordingly, a case is made out for grant of Anticipatory Bail. In view thereof, the following order is passed:
O R D E R (a) In the event of arrest of the Applicant-Gayatri Nilesh Ankam alias Gayatri Devendra Anmal in connection with C.R. No. 315 of 2026 registered with Ambegaon Police Station, Pune City, the Applicant is directed to be released on bail on furnishing P.R. Bond in the sum of Rs.30,000/- with one or two solvent sureties each in the like amount. (b) The Applicant shall attend the concerned Police Station on 1st October 2026 between 11:00 a.m. to 02:00 p.m. and shall cooperate with the investigation. In addition, the Applicants shall attend the concerned Police Station as and when called by the Investigating Officer.
(c) The Applicant shall furnish her cell phone number and 22nd September, 2026
921 ABA-2627-2026.DOC skt residential address to the Investigating Officer and shall keep the same updated, in case of any change thereto. (d) The Applicant shall not directly or indirectly make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such a person from disclosing the facts to the Court or to any Police personnel. (e) The Applicant shall not tamper with the prosecution evidence and shall not contact or influence the Complainant or any witness in any manner. (f) The Applicant shall not leave India without prior permission of the Court. 9. The Anticipatory Bail Application is disposed of accordingly. [MADHAV J. JAMDAR, J.] 22nd September, 2026
