1. Affidavit of service filed in Court today is taken on record.
2. The petitioner seeks higher scale of pay.
3. Reliance has been placed on the order dated 19th January, 2026 passed in WPA 27299 of 2025 in the matter of Subrata Das v. State of West Bengal & Ors.
4. Learned advocate representing the State respondents relies on the report forwarded by the District Inspector of Schools (Secondary Education), Barrackpore, North 24-Parganas dated 11th December, 2025 mentioning that the petitioner would not be entitled to the post graduate scale of pay.
5. Let the report of the District Inspector of Schools be kept with the records.
6. It appears that the prayer of the petitioner seeking higher scale of pay has not been disposed of

formally. Till a formal order is passed either allowing or rejecting the prayer of the petitioner, it will not be possible for the petitioner to take up the matter further.
7. In view of the above, the instant writ petition stands disposed of directing the Commissioner of School Education to consider and dispose of the petitioner’s prayer seeking higher scale of pay strictly in accordance with law and in line with the judgments and decisions passed by the Court from time to time specially in the matter of Utpal Kanti Karan v. State of West Bengal & Ors. reported in 2024 SCC Online Cal 1274 at the earliest but positively within a period of twelve weeks from the date of communication of this
order.
8. If the prayer of the petitioner is allowed, then necessary consequential steps for releasing the balance arrear payment shall be taken by the respondent authority without any further delay.
9. Learned advocate for the petitioner is
directed to forward the representation dated 15th September, 2025 along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court.
10. All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

11. Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
