The petitioner is an accused in a case registered for the offence punishable under Sections 17, 18 & 29 of the N.D.P.S Act. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. As per the allegation, the petitioner and few others were involved in illegal cultivation of poppy plants at Village-Katang. It is further submitted that the petitioner is not at all concerned with the said cultivation. The land on which the said cultivation was found is forest land. Except the hearsay statements, there is no material to connect the petitioner with the alleged offence. Similarly situated co-accused have already been granted regular bail by different Benches of this Court, orders of which have been annexed as Annexure-2 series to the present bail application. The petitioner is in judicial custody since 12.01.2026 and chargesheet against him has already been submitted. He has no criminal antecedent as has been stated in paragraph 6 of the present bail application. Hence, he may be given the privilege of regular bail. 4. Learned A.P.P opposes the petitioner’s prayer for bail. 5. Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to 2026:JHHC:6727 the satisfaction of the Special Judge, N.D.P.S, Latehar in connection with Herhanj P.S.
