Case No. 102 of 2024 dated 21.06.2024 under Sections 376(2)(d)/376C(c) of the IPC and 4/6/8/10 of the Protection of Children from Sexual Offences Act, 2012. Mr. Arka Ranjan Bhattacharya Mr. Swarup Ranjan Kar ….for the petitioner Mr. Anupam Das Adhikary Ms. Poulami Bose ….for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. In fact in the FIR, there was hardly any allegation made against the present petitioner. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He submits that when a member of the Child Welfare Committee visited a particular Home for minor girls, one of the boarders appeared scared. After enquiry, it was revealed that the President of the Home had been sexually exploiting the minor victim girls. Afterwards some other minor victims came up with the allegations that even the present petitioner who happens to be the Secretary of the Home had also sexually exploited a minor girl. Reliance was place on a hand written complaint made by the minor girl herself. 2 Considering the serious nature of allegations and the incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected.
