The petitioner is seeking regular bail in connection with A.C.B. P.S. Case No.06 of 2017 (Vigilance Case No.07 of 2017) for the alleged offences registered under Sections 420, 467, 468, 471, 406, 120(B)/34 of the I.P.C. & Section 13(2) read with 13(1)(c)(d) of the Prevention of Corruption Act, pending in the Court of learned Spl. Judge (ACB) Palamu, Daltonganj. 3. Learned counsel appearing for the petitioner submits that the petitioner happens to be the son of Mukhteshwar Prasad, who is the father of the proprietor of M/s Lotus Construction. He further submits that the road was already completed on 31.12.2012, whereas the enquiry into the quality of road was done from 21.07.2014 to 24.07.2014 and after five years of completion of work and two years of enquiry, further inspection was carried out leading to the present -2- case of excess payment to the tune of Rs.110.88 lakhs. He further submits that chargesheet has already been submitted and Mahesh Prasad, who was the Junior Engineer of P.W.D. Road, has been granted regular bail by the Co-ordinate Bench of this Court in B.A. No.12086 of 2022. He also submits that the petitioner is in custody since 22.11.2025. 4. Learned counsel appearing for the ACB opposes the prayer for bail and submits that the excess payment has been made to the said firm namely M/s Lotus Construction and petitioner happens to be the partner of the said firm. In view of that, regular bail may kindly be rejected. 5. Considering that the Junior Engineer has been granted regular bail by the Co-ordinate Bench of this Court in the aforesaid B.A. and the petitioner is in custody since 22.11.2025, and chargesheet has been submitted in this case, I am inclined to grant regular bail to the petitioner. 6. Accordingly, the petitioner, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Spl.
