By filing this application under Section 528 of BNSS, 2023 read with Article 227 of the Constitution of India, 1950, the petitioner has prayed for quashing of the FIR registered before the Jogighopa P.S. Case No.91/2025. 3. An FIR dated 01.08.2025 reveals that on an information received from a reliable source that a racket who involves themselves in transportation of fake currency as well as who involves themselves in looting block money from business man were coming by a vehicle from Guwahati towards Bongaigaon, the police personnel from Jogighopa Police Station, conducted a naka checking and during the same, at around 2:20 PM on 31st July 2025, they saw a vehicle bearing registration number AS01F4447, was proceeding from Goalpara towards Bongaigaon and on seeing the naka checking, the team inside the said vehicle turned back towards Goalpara side. The police team chased the said vehicle and with the help of Goalpara Police, intercepted the said vehicle and arrested four accused persons from inside the vehicle. The police personnel asked the said accused persons their identities, but they could not give proper answers. Thereafter, it is further stated that on interrogation of the said accused persons, it was found that they were coordinating with one Bhaskar Boro, with the intention to loot an amount of Rs. 12 crores, which was brought in a vehicle from Meghalaya towards Bongaigaon side. It is stated in the said FIR that before the accused persons caught in the other vehicles, could loot the money from the vehicle, which was coming from Meghalaya, the said vehicle was intercepted and the persons were arrested. 4. The allegations not only rested at that, but also that while asking for the ID proofs from the said accused persons, the accused persons had given fake identity proofs to the police personnel and it is specifically written in the said FIR that the petitioner, namely Wanghem Milan Singh, produced an ID card in the name of National Intelligence Bureau, (NIB) and he identified himself as a Senior Officer of the said organization. The police personnel on enquiry about the said ID proof found that the same was fake. 5. In the said FIR, four numbers of accused persons were arrested as accused of the said offence and the petitioner was mentioned as accused No.1. It is this FIR that the Page No.# 3/3 petitioner has prayed for quashing of the same. 6. Learned counsel for the petitioner submits that the story projected in the said FIR is not correct and that the petitioner is not involved in the said offence. 7. Mr. B. Sarma Learned counsel for the respondent State, however submits that not only the petitioner along with others were apprehended by the police when they tried to run away after seeing the naka checking, but also the identity proofs placed by the petitioner was fake. 8. I have considered the submissions of the parties and have gone through the copy of the FIR as well as the as well as other papers on record. 9. It is noticed that when the petitioner along with others saw the police personnel standing at a particular point to catch illegal activities, the petitioner along with others have changed the course of the vehicle and tried to flee away. The police personnel of Jogighopa police station had in fact chased the said vehicle and intercepted it after some distance and apprehended the petitioner and the others and on interrogation of the petitioners, they found out that they in connivance with another person had decided to loot money, which was coming from Meghalaya towards Bongaigaon and the ID card that were placed by the accused persons were also found to be fake. 10. In view of the said circumstances, this court does not deem it fit to quash the FIR of the instant case being Jogighopa P.S. Case No.91/2025. As such, this case is dismissed. JUDGE Comparing Assistant
