Heard Sri Kochiri Raja Shekar, learned counsel for the petitioner and Sri Chandra Sekhar, learned Assistant Government Pleader for Revenue for respondents 1 to 4. 2. The grievance of the petitioner is that the 4th respondent and his officials are proposing to conduct a survey of the land admeasuring an extent of Ac.3.82 cents in Sy.No.196/3, Chinamusidivada Village, Pendurthi Mandal, Visakhapatnam District, without issuing any notice. Learned counsel for the petitioner would submit that the petitioner was assigned the aforementioned land vide D-Patta bearing D.R.No.793 dated
05.06.1971. The petitioner intends to erect fencing to protect the land. The officials of respondents 4 and 5 visited the land on 05.09.2026 and tried to survey the land without issuing any notice and without following due procedure prescribed under the Andhra Pradesh Survey and Boundaries Act, 1923 (hereafter referred as ‘Act’).
4. Learned Assistant Government Pleader for Revenue, on instructions of the 4th respondent, would submit that the adjacent landowner made an application. A notice will be issued to the petitioner and others for conducting a field survey. Learned Assistant Government Pleader would submit that the respondent authority will follow due procedure under the Act.
5. Given the facts and circumstances of the case, without going into the merits or any other disputed questions of the matter, the writ petition is
disposed of, at the stage of admission, with the consent of both the learned counsel, directing the 4th respondent to follow due procedure prescribed under the Act vis-à-vis surveying the land admeasuring an extent of Ac.3.82 cents in Sy.No.196/3, Chinamusidivada Village, Pendurthi Mandal, Visakhapatnam District. The respondents shall not interfere with the aforementioned land without following due procedure. There shall be no order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
