1. Mr. Gaurav Singh, learned counsel for the petitioners.
2. Mr. Tumul Nainwal, learned A.G.A. for the State.
3. The instant writ petition has been preferred by the petitioner seeking the following reliefs:- (i) Issue a writ order or direction in the nature of certiorari quashing the impugned FIR lodged by the respondent no. 3 on 09.03.2026 registered as FIR No. 77 of 2026 for the offences punishable under Section 3/5/11 of the Uttarakhand Protection of Cow Progeny Act, 2007, Police Station Kotwali Roorkee, District Haridwar (contained as Annexure No. 1 to the writ petition). (ii) Issue a writ order or direction in the nature of mandamus commanding and directing the respondent no. 1 and 2 not to arrest the petitioners and not take any coercive measure against the petitioners in pursuance to the impugned FIR dated 09.03.2026 registered as FIR No. 77 of 2026 for the offences punishable under Section 3/5/11 of the Uttarakhand Protection of Cow Progeny Act, 2007, Police Station Kotwali Roorkee, District Haridwar (contained as Annexure No. 1 to the writ petition).
4. After arguing at length, learned counsel for the petitioners submits that petitioners are ready to surrender before the court concerned, however, since the
“Ramazan” is going on, the protection
may be given during this period.
5. The State counsel has no objection.
6. In such view of the matter, instant writ petition is dismissed as withdrawn with liberty to the petitioners to surrender before the court concerned on or before 04.05.2026. Till then, the petitioner shall not be arrested provided they cooperate with the investigation.
