M S R SASHI BHUSHAN 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM CRIMINAL PETITION NO: 4103 of 2024 The Court made the following Order: Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioner herein (Accused), seeking to quash the proceedings in FIR in Crime No.256 of 2024 of Muvvalavanipalem Police Station, Visakhapatnam Commissionerate District, for the offences punishable under Sections 429 of the Indian Penal Code and Section 11(1)(h) of the Prevention of Cruelty to Animals Act, 1960. 2. At the stage of admission, this Court has not granted any interim order in the instant lis. 3. Mr.V.Sai Kiran, learned counsel representing the learned counsel for the petitioner, submits that, in view of the subsequent events that have taken place in the lis, the police have filed a charge sheet in the Crime No.256 of 2024 of Muvvalavanipalem Police Station, Visakhapatnam Commissionerate District. As such, he seeks permission of this Court to withdraw the present Criminal Petition, with liberty to avail appropriate legal remedies in accordance with law. 4 4. Learned Assistant Public Prosecutor also did not dispute the same. 5. Considering the facts and circumstances of the lis, and in view of the submissions of the learned counsel for the petitioner, the Criminal Petition is closed, by granting liberty to pursue legal remedies, in accordance with the law.
