ORAL ORDER
1. This petition is filed by accused No. 5 under Section 483 of BNSS praying to grant bail in Crime No. 122/2025 of Robertsonpet Police Station registered for offence under Sections 306, 238, 61(2), 95, 3(5) of BNS and Section 83 of Juvenile Justice (Care and Protection of Children) Act.

Learned counsel for petitioner would contend that the accusation against this petitioner is that he along with accused Nos. 1 to 4 and juvenile accused Nos. 1 and 2 planed to commit theft in the jewellery shop. After juvenile accused committed theft in the jewellery shop, they brought the stolen jewellery articles to Bhim, Rajasthan and met this petitioner and accused Nos. 2, 3 and 7. Thereafter accused Nos. 5, 6 and this petitioner

took juvenile accused Nos. 1 and 2 to the house of one acquaintance of accused No. 6. Thereafter accused No. 6 and this petitioner took the stolen golden articles for getting them checked and they took two chains weighing 55 grams and sold it to C.W.13 for Rs.4,00,000/- and had taken Rs.3,50,000/- keeping balance of Rs.50,000/-. Out of it petitioner took Rs.50,000/- and gave Rs.2,00,000/- to juvenile accused Nos. 1 and 2. There is no recovery from this petitioner. Petitioner is in judicial custody since 30.10.2025 and as chargesheet is filed, he is not required for further custodial interrogation. The offence alleged against the petitioner is not punishable with death or imprisonment for life. With this he prayed to allow the petition. 4. Per contra learned Additional SPP would contend that there is theft of jewellery worth Rs.1.3/- crores. Petitioner and accused Nos. 1 to 4 have planned to commit theft in the jewellery shop and in furtherance of the said conspiracy they sent juvenile accused No. 1 to

join the shop. He committed theft of jewelleries in the shop and brought them to Bhim, Rajasthan along with accused No. 2 and met this petitioner and accused Nos. 2, 3 and 7 and they gave this petitioner and accused No. 6 some jewellery who sold it to C.W.13 for Rs.4,00,000/- and out of it, gave Rs.2,00,000/- to juvenile accused Nos. 1 and 2 and this petitioner took Rs.50,000/-. There is no recovery from this petitioner of the said Rs.50,000/- as he had spent the said amount. The offence alleged against the petitioner is a heinous offence punishable with imprisonment which may extend to 10 years. Chargesheet material show prima facie case against the petitioner for offence alleged against him. With this he prayed to reject the petition. 5.
Having heard learned counsel for the parties, this Court has perused the chargesheet and other materials placed on record. - 5 -

6. This Court, while considering the bail petition of accused No. 6 in the order dated 28.01.2026 passed in Crl.P. No. 17314/2025 has observed as under:
“6. On perusal of column - 17 of the charge sheet indicates that accused Nos.1 to 5 and juvenile accused Nos.1 and 2 have planned to commit theft in the jewellary shop. In furtherance of their conspiracy juvenile accused No.1 was made to join the shop of Bastimal Bohra and was staying in a lodge at KGF and accused No.1 was paying for the charges of the said lodge. The juvenile accused Nos.1 and 2 were in contact with the accused persons. That on 15.10.2025, when the said shop was under process of cleaning for Diwali festival, in the afternoon when there were nobody in the first floor, juvenile accused No.1 in the guise of going to toilet, went to first floor, took two plastic boxes containing 1 kg 93 grams 400 miligrams weighing golden ornaments and went to bathroom situated in second floor and kept the golden ornaments in his pant and threw the plastic boxes there and came out of the shop and asked juvenile accused No.2 to come to Gandhi

Circle. Thereafter, they went to Bhim at Rajasthan and met accused Nos.2, 3, 5, 7 and went with them to the garden house of this petitioner/accused No.6. Thereafter accused Nos. 3, 5 and this petitioner/accused No.6 took juvenile accused Nos.1 and 2 to the house of acquaintance of this petitioner. Thereafter on 18.10.2025, accused Nos.5 and 6 took the stolen golden articles for getting them checked and they took two chains weighing 55 grams and sold it to CW.13 for Rs.4,00,000/- and taken Rs.3,50,000/- keeping balance of Rs.50,000/-.
Out of them accused No.5 took Rs.50,000/- and the Juvenile accused Nos.1 and 2 were informed by accused No.3 that they were sold for Rs.3,50,000/- and gave them Rs.2,00,000/- and told them that he will give remaining amount subsequently and took the remaining articles and went away. Thereafter juvenile accused Nos.1 and 2 and accused No.3 went to Godaji Village and gave Rs.2,00,000/- to accused No.4. Thereafter accused Nos.5 and 6 went to his house and talked with him and divided the stolen golden articles in two parts and went away. Thereafter on 22.10.2025, this

petitioner/accused No.6 came to Dungaji Ka Gaon Village through accused No.7 secured accused No.5, took the golden ornaments from him, stating that they will be sold through this petitioner/accused No.6.”

Considering the above aspects, the role of this petitioner is that he made a plan along with accused Nos. 1 to 4, and juvenile accused Nos. 1 and 2 committed theft, brought the gold articles to Bhim, Rajasthan. Out of those gold ornaments, the petitioner and accused No. 6 sold some jewellery and received Rs.4,00,000/- and gave Rs.2,00,000/- to the juvenile accused and this petitioner had received Rs.50,000/- as his share. There is no recovery of any amount from this petitioner. Petitioner is in judicial custody since 30.10.2015 and as chargesheet is filed he is not required for further custodial interrogation. The offence alleged against the petitioner is not punishable with either death or imprisonment for life. 8. Considering the above aspects petitioner has made out case for grant of bail with conditions. - 8 -

In the result, the following;
O R D E R
Petition is allowed. Petitioner is granted bail in Crime No. 122/2025 of Robertsonpet Police Station subject to following conditions: I. Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with a two sureties for the likesum to the satisfaction of the jurisdictional Court. II.
Petitioner shall not tamper the prosecution witnesses either directly or indirectly. III. Petitioner shall attend the trial Court on all dates of hearing unless exempted and cooperate for speedy disposal of the case. IV. Petitioner shall not involve in commission of any offence. If the petitioner is found involved in commission of any offence, prosecution is at liberty to seek for cancellation of bail granted to him. Sd/- (SHIVASHANKAR AMARANNAVAR) JUDGE
