This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the applicants, who are apprehending their arrest in connection with GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.02.04 15:04:14 +0530 2 Crime No. 0396/2025 registered at Police Station – Basna, Dist. Mahasamund, (C.G.) for the offences punishable under Sections 115(2), 296, 3(5) and 85 of BNS, 2023. 2. According to the prosecution's case, it is alleged that the applicant and his family members have demanded dowry from the complainant in the form of gold, cash and 4-wheeler and further she has been physically and mentally harassed by the applicant and his family members. Pertinently, an FIR at P.S.- Basna, Dist Mahasamund, (C.G.) for the offence under section 115(2), 296, 3(5) and 85 BNS, 2023 was lodged by the complainant. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in this case. He submits that this matter was previously listed before this Court on 04/12/2025, and was referred for mediation, which took place on 27/01/2026. Although both parties appeared, the mediation ultimately failed, therefore, he prays for grant of anticipatory bail to the present applicants. 4. On the other hand, learned State counsel as well as learned counsel for the complainant opposed the prayer for grant of anticipatory bail of the present applicants. 5. I have heard learned counsel for the parties and perused the materials available on record. 3 6. Considering the facts & circumstances of the case, and further the fact that this matter was previously listed before this Court on 04/12/2025, and was referred for mediation, which took place on 27/01/2026, although both parties appeared, the mediation ultimately failed, therefore, without further commenting anything on merits of the case, I am inclined to grant anticipatory bail to the applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Khalid Usman Memon & Shahida Khalid Memon, on each of them executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of 4 his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
