This writ Petition is filed praying this Court to declare the action on the part of respondents No.2 to 4 in temporarily promoting the petitioner to the post of the Senior Assistant at Parent Institution, i.e., Sri Veera Venkata Satyanarayana Swamy Devasthanam, Annavaram on paper, instead of promoting the petitioner to the post of the Senior Assistant in Sri Tirupatamma Ammavaari Devasthanam, Penuganchiprolu, through the proceedings dated 17.08.2024, even though, there are vacancies available as on the date of paper promotion, as arbitrary, illegal colourable exercise of power and well established legal principles apart from being violative of the fundamental rights guaranteed under the Constitution of India and consequently, direct the respondent No.4 to assign the duties of the post of Senior Assistant in Respondent No.4 temple and grant the service benefits and monetary benefits with effect from 17.08.2024 and pass such other orders. 2. The case of the petitioner is that the petitioner was appointed as Record Assistant in Sri Veera Venkata Satyanarayana Swamy Devasthanam, Annavaram on 13.07.2010 and he was promoted as Junior Assistant on 01.07.2012. In the year 2016 he was transferred to Sri Durga Malleswara Swamy Varla Devasthanam, Vijayawada. From there, again he was transferred 4 BM,J W.P.No. 28970 of 2024 Dated 22.09.2026 to Sri Tirupatamma Ammavaari Devasthanam, Penuganchiprolu on 30.06.2022. On 17.08.2024 the 3rd respondent has issued proceedings in Rc.No.A1/503/2017, E.No.445172 promoting the petitioner to the post of Senior Assistant in his parent institution i.e., 3rd respondent temple. Petitioner though was promoted, has been assigned the duties of Junior Assistant. When he made a request for implementation of the said promotion order, 4th Respondent informed that there are no vacancies in 4th Respondent temple, hence, the same was not implemented. Now, it is stated by the learned Counsel for the petitioner that on 11.06.2025 petitioner was again transferred to his parent temple i.e., 3rd Respondent Temple and accordingly, he joined in 3rd Respondent temple. As the petitioner’s promotion was not effected on account of no vacancy in the cadre of Senior Assistant in 4th respondent temple, as the petitioner was promoted as Senior Assistant in his patent temple i.e., 3rd respondent temple, he is entitled for implementation of the same in the 3rd respondent temple that is with effect from the date of original promotion order, dated 17.08.2024. 3. Learned Standing counsel appearing for the Endowments, submitted that petitioner was transferred back to the 3rd respondent temple, his case will be considered by the 3rd respondent temple for effecting the earlier promotion and 5 BM,J W.P.No. 28970 of 2024 Dated 22.09.2026 will be entered in the service register to that effect as per the Promotion Order, dated 17.08.2024. 4. Considering the submissions made by the learned counsel for the 3rd respondent temple, 3rd respondent is directed to implement the order of promotion, dated 17.08.2024 and effect necessary entries in the service register of the petitioner and also all the consequential benefits in favor of the petitioner with effect from 17.08.2024 in the 3rd respondent temple, within a period of eight (08) weeks from the date of receipt of a copy of this Order. 5. Accordingly, the Writ Petition is disposed of. No costs.
