(At Present In Judicial Custody In Central Jail Ajmer). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Pradeep Sharma For Respondent(s) : Mr. Jaiprakash Tiwari, PP Mr. Pankaj, CI, PS Nasirabad, Ajmer is present in person HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 07/04/2026 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.13/2026 registered at Police Station Nasirabad City, District Ajmer for offences under Sections 143(2), 111(3), 318(2) and 316(2) of BNS, 2023, Section 24 Emigration Act, 1983 and Section 66D of IT Act. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that, as per the allegations leveled in the FIR, it is evident that the role of the present petitioner was limited to offering a job in Bangkok and arranged a flight ticket for the same. Though subsequently being dissatisfied with job work complainant returned back to India. The petitioner has been in custody since 18.02.2026 and [2026:RJ-JP:14281] (2 of 2) [CRLMB-3688/2026] has no prior criminal record. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, consequently, the bail application deserves to be allowed. 4. The Investigating Officer, who is present in Court, has submitted that the role of the petitioner was limited to offering the job opportunity to the complainant in abroad and providing the flight ticket. The Officer has admitted that the petitioner was not in contact with the person who was responsible for providing employment to the complainant in Myanmar. 5. Learned Public Prosecutor has vehemently opposed the bail application. 6. On consideration of the rival submissions and material available on record and in light of submission made by learned counsel for the petitioner, especially the role of the petitioner is limited but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 7. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Birendra Singh Rawat S/o Shri Sujan Singh Rawat, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
