CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER The grievance of the petitioner is directed towards Annexure-A, the impugned Official Memorandum at Annexure-A dated 24.09.2018 issued by the Deputy Commissioner, Chikkaballapura District, reserving various extent of land for the purpose of grant to deserving persons under the scheme
"Urigondu Thopu' and 'Hasiru Karnataka'. Learned counsel for the petitioner submits that earlier when the application filed by the petitioner seeking regularization of unauthorized occupation was rejected, the petitioner filed an appeal before the Assistant Commissioner, Chikkaballapura Sub-Division in proceedings bearing No.L.N.D.R.A(Gowri)75/2023-24.
The Assistant Commissioner accepted the contention of the petitioner that since she is uneducated, a wrong survey number was shown in the application seeking regularization of unauthorized occupation and accordingly, the Assistant Commissioner set aside the earlier decision of the Committee while directing the Committee to re-consider the application filed by the petitioner in respect of 3 acres and 32 guntas in Sy.No.30 of Tekalahalli Village, Manchenahalli Hobli, Gauribidanur Taluk. HC-KAR NC: 2026:KHC:10912 WP No. 4589 of 2026 counsel submits that when the matter is still pending
consideration before the Committee, the Deputy Commissioner has passed the impugned order which also contains at Sl.No.116 description of the property in question namely 3 acres 22 guntas in Sy.No.30 of Tekalahalli Village, Manchenahalli Hobli, Gowribidanur Taluk.
Consequently, the writ petition is allowed the impugned Official Memorandum at Annexure-A dated 24.09.2018 issued by the Deputy Commissioner, Chikkaballapura District is set aside insofar as Sl.No.116 is concerned in respect of the land in question namely 3 acres 22 guntas in Sy.No.30 of Tekalahalli Village, Manchenahalli Hobli, Gowribidanur Taluk.
Respondent No.3 - Tahsildar, Gauribidanur Taluk is hereby directed to place the application of the petitioner before the Committee for regularization of unauthorized occupation in terms of directions issued by the Assistant Commissioner. So that the Committee shall re-consider the application in the light of the observations made by the Assistant Commissioner and dispose of the application. The Tahsildar shall place the application before the Committee within a period of four weeks

HC-KAR NC: 2026:KHC:10912 WP No. 4589 of 2026 from the date of receipt of copy of this order, the Committee shall thereafter re-consider the application and pass necessary orders as expeditiously as possible and at any rate within a period of two months from the date when which the application would be placed by the Tahsildar before the Committee.
