This bail application has been filed on behalf of Chandradev Oraon who is in custody since 05.12.2025 in connection with Latehar P.S. Case No. 251 of 2022 for the offence registered under Sections 147, 148, 149, 341, 342, 323, 324, 326, 307, 332, 333, 353, 354, 504, 506, 509 and 120B of the IPC and Section 3 of Prevention of Damage to Public Property Act, pending in the Court of CJM, Latehar, is pressed into motion. As per the prosecution case, an unlawful assembly of about 400 to 500 persons attacked the Civil Court area in which several police personnel and executive officials were seriously injured. It is submitted by the learned counsel on behalf of petitioner that the offence under Sections 326 and 307 of IPC will not be made out as there is no allegation that any deadly weapon was used. The petitioner has been implicated in the case as being a member of unlawful assembly, but no overt act has been attributed to him and no one had sustained any grievous injury. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below subject to the condition that one of the bailors must be close relatives of the petitioner and that he shall not commit an offence, similar to the offence of which he is accused in the present case.
