The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, challenging the agenda notice dated 12th June, 2026 issued by Mr. Rajender Kumar, Administrator cum Returning Officer of the Respondent No. 1- Low Income Group Government Servants Co-operative House Building Society Ltd. (hereinafter, ‘Society’). 3. Vide the impugned agenda notice, the schedule for elections for the Managing Committee of the Society have been announced. 4. The submission on behalf of Petitioner is that the Petitioner has been held to be a defaulter and is not being permitted to vote in the forthcoming This is a digitally signed order. Counsel for the Petitioner has clearly admitted that the Petitioner was declared a defaulter in October, 2025 and he has challenged the same before the Registrar Cooperative Societies (hereinafter, ‘RCS’). 6. Under such circumstances, once the elections have been called by the Administrator cum Returning Officer, this Court is not inclined to entertain any petition to interdict in the elections for the Managing Committee of the Society at this stage. 7. Accordingly, the elections shall continue as per the schedule fixed. Challenges to the elections, if any, shall be raised in accordance with law. 8. Since the Petitioner has approached the RCS, the RCS shall decide his representation within a period of three months. 9. The petition is disposed of in the above terms.
