LEGAL AID The Court made the following: ORDER: The Criminal Petition has been filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C’)/Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’), challenging the judgment dated 27.07.2023 passed in Crl.A.No.87 of 2020 on the file of the learned I Additional Sessions Judge, Krishna, Machilipatnam (for brevity ‘learned Appellate Court’), whereby and whereunder the judgment dated 28.02.2020 passed in C.C.No.114 of 2018 on the file of the learned Special Judicial Magistrate of First Class (Mobile) for Trial of Cases under P.C.R. Act-cum-IX Metropolitan Magistrate-cum-IV Additional Junior Civil Judge, Machilipatnam (for brevity ‘learned Trial Court’), was confirmed. 2. Heard the learned Legal Aid Counsel for the petitioner, the learned Legal Aid Counsel for respondent Nos.1 to 5 and the learned Assistant Public Prosecutor for the State. 3 3. The learned Trial Court acquitted respondent Nos.1 to 5/Accused Nos.1 to 5 for the charges under Section 498-A of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act, as they were not found guilty. The learned Appellate Court, also appraising the evidence of the witnesses of the prosecution and also the grounds raised by the petitioner/appellant/de facto complainant in her appeal, dismissed the Criminal Appeal, confirming the judgment of the learned Trial Court. 4. On perusal of the entire material on record, there is no material irregularity or miscarriage of justice. 5. Having regard to the facts and circumstances of the case, the Criminal Revision Case is dismissed, confirming the judgment dated 27.07.2023 passed in Crl.A.No.87 of 2020 on the file of the learned I Additional Sessions Judge, Krishna, Machilipatnam, and the judgment dated 28.02.2020 passed in C.C.No.114 of 2018 on the file of the learned Special Judicial Magistrate of First Class (Mobile) for Trial of Cases under P.C.R.
