3. Per contra, learned Public Prosecutor has vehemently opposed the instant bail application and has submitted that dodapsot of approximately 113.960 kgs is allegedly recovered from the possession of three persons including the applicant and the same is more than the prescribed commercial quantity of 50 kilograms, and therefore, it is submitted that strict rigours as enshrined under Section 37 of the NDPS would be applicable in the present case.
4. Having heard the arguments advanced by learned counsel for the parties, taking note of the fact that the recovered quantity of dodapost i.e., 113.960 kilograms is higher than the prescribed commercial quantity of 50 kilograms, relying upon stringent statutory provisions as enshrined under Section 37 of the NDPS Act, and looking to the overall facts and circumstances of the case and material available on record but without commenting on merits/demerits of the case, this court is not inclined to allow the bail application of the accused-applicant.
5. Accordingly, the present bail application filed under Section 483 BNSS stands dismissed.
