Heard the learned counsel for the parties. 4. The present writ petition has been filed for following reliefs:- “a) For issuance of an appropriate writ, order or direction to Respondents to set aside the order dated 19.11.2022 whereby and wherein the Grievance Redressal Committee has disposed the grievance of the Petitioner by directing him to submit 'No objection' from the awardees/certificate holders within 8 weeks consenting Petitioner (herein) as one candidate/nominee for the Job for the land of 0.20 Acre. ANNEXURE 3. 2026:JHHC:3505 Page | 2 W.P. (C) No.2280 of 2023 b) For issuance of an appropriate writ, order or direction to Respondents to re-constitute the Grievance Redressal committee in view of the fact that presence of three members of 6 members i.e. Durga Charam Murmu, not from the same gram village, Bidyut Baran Mahato, Member of Lok Sabha (not present & signed by representative), Dr. V.N. The land has been acquired for the purpose of Uranium Corporation of India Ltd. (In short UCIL). Acquisition of land and job in lieu of that acquisition is not in dispute as per the order passed by the grievance committee in its order dated 19.11.2022. The recommendations are as follows:- “Recommendations: The committee recommends the followings: 1. That UCIL shall ask the applicant to submit "No Objection" from awardees/certificate holders within 08(Eight) weeks from the date of issue of letter to him by UCIL and all Awardees/Certificate holders should nominate Shri P.K.Mandal Son of Gnagadhar Mandal as consensus one candidate/nominee for the job for the land of 0.20 Acre. 2. That compliance to SL No 1, Shri P.K.Mandal, son of Gnagadhar Mandal shall be provided employment with effect from date of submission of "No Objection" from all Awardees/Certificate holders. 3. That in case of non-compliance to SL No 1 & 2, UCIL shall publish advertisement for fresh employment within 8(Eight) weeks for the land in question.” 6. As per the policy, which has been brought to my notice, that is the basis for consideration, is Clause 4.1.1 of UCIL Rehabilitation & Resettlement Policy which is quoted hereinbelow:- “4.1.1. Note for Provision of Employment (1) Amongst the Certificate holders for subsequent employment, the preference will be given based on the quantum of land. (2) All the above provisions are subject to vacancies in Projects. However, the Company reserves the right to transfer any of its employees from any unit to meet the requirement in accordance with their terms of employment. (3) In case of joint awardees/certificate holders, all Awardees / Certificate holders should nominate in consensus one candidate / nominee for the job. In case of non-availability of consensus 2026:JHHC:3505 Page | 3 W.P. (C) No.2280 of 2023 candidate, the candidate /nominee nominated by the majority of the awardees / signatories or their legal heir will be considered for employment. In case of non-availability of consensus candidate even after a period of 01 (one) year, all candidates/nominees will be considered for test and interview as decided by the company and based on the test and interview one candidate will be considered for employment. Any grievance received in this regard, will be referred to the grievance redressal committee and decision of the committee will be final and binding to all and till disposal of the grievance, the certificate will be kept pending. (4) Recruitment procedure will be as per the Provisions of UCIL Recruitment & Promotions Rules 1973 as amended from time to time.” 7. Thus, it has been submitted by the learned counsel for the petitioner that the family members are entitled for one job and admittedly there is no consensus as the parties are competing to each other. This situation has been contemplated under the rehabilitation policy and the rehabilitation policy itself provides the mechanism to resolve the same. It has been provided that if within a year no consensus reaches the among the family members then the UCIL has been given liberty to select the candidate on the basis of interview among the eligible family members. 8. In view of above factual matrix and rehabilitation policy, the present writ petition is hereby disposed of directing the respondent No.2-Deputy Commissioner-cum-Chairman of the Grievance Redressal Committee to act as per the above policy and select the candidate on the basis of consensus as more than a year has lapsed and no consensus has reached among the family members. 9. The above exercise must be completed within three months from the date of receipt/ production of a copy of this order. 10. With above observation and direction, the present writ petition is hereby disposed of. (Rajesh Kumar, J.) Dated: 10th February, 2026 Amar/- Uploaded on 12.02.2026
