2. This is an application under Article 227 of the Constitution of India challenging the
order dated 30.06.2026 passed by the learned Civil Judge (Senior Division), Karbi Anglong, Diphu in Title Suit No.12/2024.
3. The petitioner is a plaintiff before the Trial Court. For certain reasons, the plaintiff was debarred from adducing evidence. The plaintiff approached this Court and this Court in CRP(IO)229/2026 allowed the prayer of the petitioner subject to payment of cost of Rs.10,000/-. The petitioner was directed to appear before the trial court on 30.06.2026.
4. Accordingly, the petitioner appeared before the Trial Court and deposited the cost of Rs.10,000/-, but he prayed for some more time to examine witnesses. Interpreting the order of this Court dated 10.06.2026, the Trial Court refused to extend the time.
5. I have considered the submission made by the learned counsel Mr. Dutta.
6. This Court is of the opinion that for the ends of justice, the petitioner/plaintiff should be given at least one opportunity to examine witnesses.
7. Therefore, the order dated 30.06.2026 passed by the learned Civil Judge (Senior Division), Karbi Anglong, Diphu in Title Suit No.12/2024 is set aside.
8. The Trial Court is directed to provide another opportunity to the plaintiff to examine his witnesses. With the aforesaid direction, the Revision Petition is disposed of in Motion stage itself.
