1. The application has been filed seeking regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023 (‘BNSS’), in connection with FIR No. 281/2015 for offences punishable under Section 302/364/365/201/120-B/34 of the Indian Penal Code, 1860 (IPC) registered at P.S. GTB Enclave, Delhi.
2. As per the FIR, it is alleged that on 01.04.2015, the applicant and co- accused kidnapped Sagar Choudhary @ Chunnu i.e. the deceased, from GTB Enclave, following a dispute over the deceased elopement with the co- accused’s sister-in-law.
3. The accused persons allegedly pushed the deceased in front of a running Truck in Sahibabad, Uttar Pradesh, causing fatal injuries. The facts This is a digitally signed order. of the case would further indicate that there were total six accused persons. Except applicant, all of them have been granted regular bail. Even the present applicant was also granted regular bail, however, on a complaint made by the complainant with respect to extending threat to PW-18, the bail granted to the applicant was cancelled by the Trial Court.
4. Against the cancellation of the bail, the applicant approached this Court, and vide Order dated 16.07.2024, this Court declined to interfere into the same. The applicant, thereafter, approached the Supreme Court and the Supreme Court vide Order dated 03.01.2025 made following observations:
“1. Delay condoned.
2. We are not inclined to entertain this petition at this stage. The special leave petition is, accordingly, dismissed.
3. However, we request the learned Trial Judge to expedite the trial and conclude the same as expeditiously as possible and in any case within a period of one year from today.
4. If the trial does not conclude within a period of one year from today, the petitioner would be entitled to renew his request.
5. Pending application(s), if any, shall stand disposed of.”

Learned counsel for the applicant, therefore, submits that out of 49 witnesses, about 35 witnesses have already been examined and according to the petitioner, none of them have supported the prosecution’s case and there is no likelihood of the applicant being convicted. It is submitted that the applicant shall abide by all terms and conditions as the Court may like to impose.
6. As per the nominal record, as on 22.04.2026, the applicant has already completed 6 years 7 months and 2 days in incarceration. Therefore, having considered the overall facts and circumstances and the fact that the petitioner was earlier admitted to regular bail and the trial has not been completed, as was directed by the Supreme Court in its order dated 03.01.2025, the delay This is a digitally signed order. in trial is not attributable to the applicant.
7. The facts would further indicate that all the other accused persons have already been admitted to regular bail. The applicant is, therefore, admitted to regular bail subject to the conditions to be imposed by the concerned Trial Court. It is directed that the Trial Court shall bear in mind the past conduct of the applicant and shall impose appropriate conditions to secure the applicant’s presence for facing of the further trial.
8. With the aforesaid the bail application stands disposed of.
