JUSTICE SATYAVRAT VERMA ORAL ORDER 2 06-05-2026 1. Heard learned counsel for the petitioner and the learned APP for the State. 2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 238, 61(2) of the Bharatiya Nyaya Sanhita. 3. The learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is in custody since 13.08.2025 and the informant alleges that his daughter was married to the petitioner in the year 1999 and out of wedlock, a son (Chintu) was born, his daughter died in the year 2012, thereafter petitioner in the year 2014 performed his second marriage with Nilu, next alleges that on 11.08.2025, Patna High Court CR. No.16999 of 2026(2) dt.06-05-2026 2/4 he received an information that Chintu aged about 22 years committed suicide, accordingly, he reached the place of occurrence when petitioner informed that Chintu is missing since the night of 10.08.2025, but on query, Nilu disclosed that her relation with Chintu was like son and mother and Chintu at times used to kiss her, further in the night of 10.08.2025 / 11.08.2025 in the midnight, Chintu kissed her and said that she is not his mother, the petitioner heard and thereafter a scuffle ensued and petitioner strangulated Chintu to death, thereafter petitioner called his brother Shailendra and neighbour, Dina and disclosed that Chintu acted inappropriately with Nilu, thus, killed him and thus sought their help in disposing of the dead body, thereafter they took the dead body with an intent to dispose of by wrapping the dead body in a bed sheet. 4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegations as alleged in the FIR, it would manifest that informant is not an eye witness to the occurrence. It is next submitted that the informant does not disclose how he came to know that Chintu committed suicide. It is further submitted that petitioner is father of Chintu and as such no father would kill his Patna High Court CR. MISC. No.16999 of 2026(2) dt.06-05-2026 3/4 own son. It is also submitted that no doubt Nilu disclosed to the informant about her relationship with Chintu, but then she disclosed that the relationship was like mother and son. It is also submitted that even if Chintu on the date of occurrence said that she is not her mother that in itself could not have enraged the petitioner to an extent to kill the deceased. It is also submitted that Nilu also filed an application before the learned ACJM-I, Hilsa (Nalanda) wherein she disclosed that Chintu committed suicide. 5. Learned A.P.P. for the State, Mr. Chandra Bhushan Prasad, vehemently opposes the regular bail application of the petitioner. It is submitted that the allegation as alleged gives an impression that deceased and Nilu were in a relationship and the said relationship came to the knowledge of the petitioner who in rage committed the murder of Chintu. It is also submitted that Nilu also disclosed that after strangulating Chintu to death, the petitioner called his brother and co-villager, Dina and sought their help in disposing of the dead body and the dead body was wrapped in a bed sheet and thereafter disposed of. It is further submitted that when informant reached the place of occurrence, the petitioner disclosed that Chintu was missing since 10.08.2025, but then petitioner did not disclose the said fact to Patna High Court CR. No.16999 of 2026(2) dt.06-05-2026 4/4 the informant that his maternal grandson is missing, rather when he came to know that Chintu committed suicide, he came to the place of occurrence when the said fact was disclosed. It is also submitted that till date body has not been recovered, as such, no credence can be given to the application filed by Nilu before the learned ACJM-I, Hilsa, Nalanda. It is further submitted that had postmortem of the dead body been conducted, in that event, the cause of death would have surfaced. 6. After hearing the learned counsel for the parties, the Court is not inclined to release the petitioner on bail. 7. Accordingly, the instant regular bail application stands rejected.
