JUSTICE S.G.PANDIT) Petitioner, aggrieved by order dated 25.11.2024 in Application No.4082/2024 passed by the Karnataka State Administrative Tribunal at Bengaluru (for short, ‘the Tribunal’) rejecting petitioner’s prayer for quashing the order of suspension dated 14.08.2024 (Annexure-A11) is before this Court. 2. Heard learned counsel Sri.Shreedhar G. Bidre for Sri.Raghavendra G. Gayatri, learned counsel for the - 3 - HC-KAR NC: 2026:KHC:6985-DB WP No. 32759 of 2024 petitioner and learned Additional Government Advocate Sri.Vikas Rojipura for respondent Nos.1 and 2. 3. Learned counsel for the petitioner would submit that the petitioner was kept under suspension by order dated 14.08.2024 (Annexure-A11) and the articles of charge was received by petitioner on 14.03.2025 which was dispatched on 10.03.2025. Therefore, learned counsel would submit that in terms of Rule 10(5)(b) of the Karnataka Civil Services (Classification, Control and Appeal) Rules, 1957 (for short, ‘CCA Rules’), petitioner needs to be reinstated into service, as the articles of charge is not issued within a period of six months from the date of suspension. 4. However, learned Additional Government Advocate would submit that the Government shall have to take decision as to whether the continuance of petitioner under suspension would be necessary during the course of the enquiry and the decision would be taken within fifteen days from today. - 4 - HC-KAR NC: 2026:KHC:6985-DB WP No. 32759 of 2024 5. The petitioner who is a Taluka Backward Classes Welfare Officer at Ramanagara was kept under suspension under Government order dated 14.08.2024 (Annexure-A11) and the articles of charge is dispatched on 10.03.2025 and the petitioner has received the same on 14.03.2025. In terms of Rule 10(5)(b) of CCA Rules, the appointing authority shall have to pass appropriate order in the above circumstances. Hence, the following: ORDER a) Respondent Nos.1 and 2 are directed to pass appropriate order under Rule 10(5)(b) of CCA Rules within 15 days from today. b) Interim order granted earlier shall continue till passing of the order by the respondents. c) Accordingly, writ petition stands disposed of.
