Instant Writ Petition under Article 226 of the Constitution of India, has been filed on behalf of petitioners, for the following relief:
“ to issue an appropriate writ order or direction more particularly one in the nature of WRIT OF MANDAMUS to declare the inaction of the Respondents no.2 to 4 to registering the crime against the respondent no.5 to 15 on petitioner complaint dt 12.01.2026/05.01.2026 in FIR in cr.no.03/2026 on the file of Hiramandalam Police station Srikakulam district is highly illegal, arbitrary and violation of Art. 14, 21 of Constitution of India and also violation of Principles of Natural Justice and consequently direct Respondents No.2 to 4 to registering the crime against the respondent no.5 to 15 on petitioner complaint dt 12.01.2026/05.01.2026 in FIR in cr.no.03/2026 on the file of Hiramandalam Police station Srikakulam district by conducting proper investigation in accordance with law and pass”

Today when the matter is taken up for hearing, learned Assistant Government Pleader for Home, on written instructions, states that police, after due investigation, filed charge-sheet in FIR in Crime No.03 of 2026 of Hiramandalam Police Station, Srikakulam District before Judicial Magistrate of First Class, Kothuru, Srikakulam District, against Darapu Shanmukha Rao

(A1) and Darapu Sampati Rao (A2). A copy of written instructions of Station House Officer, Hiramandalam Police Station, Srikakulam District also forwarded to learned counsel for petitioners. 3. At that juncture, learned counsel for petitioners seeks permission of this Court to withdraw the present writ petition to work out their legal remedies in accordance with law. 4. Considering submissions made by both the counsel, writ petition is dismissed as withdrawn. However, it is made clear that all the remedies are left open to the respective parties to proceed, in accordance with the law. No costs.
