2/15.01.2026 Heard learned counsel appearing on behalf of Petitioners and
learned counsel appearing on behalf of the State.
2. The petitioners are apprehending their arrest in connection with R.I.T. P.S. Case No. 101 of 2024(S) registered under sections 126(2)/115(2)/118(1)/117(2)109/352/3(5) of BNS, 2023, pending in the Court of learned SDJM, Seraikella.

Learned counsel appearing for the petitioner submits that there are case and counter case between both the parties and the both the parties are neighbors and the altercation took place with regard to the drain water. He next submits that there are general and omnibus allegations. He next submits that injury is there, however, now the matter has been settled between the parties and the compromise petition has also been filed before the Learned Session Judge however the learned Session Judge has been pleased to reject the anticipatory bail. He then submits that one co-accused has been granted anticipatory bail in ABA No. 5393 of 2025.

Learned counsel appearing for the state opposed the prayer and submits that the alleged sections are not compoundable.

Considering that there are case and counter case between the parties and there are general and omnibus allegation, the joint compromise petition has been filed which was signed by both the sides and the joint compromise petition was filed before the learned Session Judge, which was annexed in ABA No. 5393 of 2025 and that fact has come in the order dated 23.9.2025 passed in ABA No. 5393 of 2025, I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the petitioners above named are directed to surrender before the learned Court within three weeks from the date of receipt of the order and on the event of their surrender / arrest, they shall be released on bail on furnishing bail bond of Rs.25,000/- (Twenty-Five Thousand) each with two sureties of the like amount of each to the satisfaction of learned SDJM, Seraikella, in connection with R.I.T. P.S. Case No. 101 of 2024(S), subject to the condition as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
7. This Anticipatory Bail Application is accordingly allowed and
disposed of.
