Heard Mr. Virendra Verma, learned counsel for the appellant. Also heard Mr. Nitansh Jaiswal, learned Dy. G.A., appearing for the respondent/State. 2. This criminal appeal has been preferred by the appellant under Section 413 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘BNSS’) seeking conviction of the accused persons for offences under Section 448, 323, 325, 302, 34 of IPC and enhance the sentence awarded to the accused persons. 3. At the outset, learned counsel for the appellant states that the present appeal be dismissed as withdrawn as the appellant has already preferred an Acquittal Appeal against the acquittal of the accused respondent and for enhancement of sentence also, being ACQA No. 393/2025 which is listed today along with criminal appeals filed by the appellants against the conviction. 4.
