1. Heard Mr. S. C. Biswas, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of PRC Case No.84/2020 under Sections
Page No.# 2/3 120(B)/406/420 of the IPC read with Section 5 of the Assam Protection of Interests of Depositors Act, 2013 read with Sections 4, 5, 6 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, pending in the Court of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. 3. The petitioner, Arun Maji has been shown as an absconder in the Charge- Sheet and he has received summons from the Court below. The petitioner apprehends that since he has been shown as an absconder in the Charge-Sheet he may be remanded to custody. The petitioner submits that he now wants to contest the case before the Trial Court and therefore deserves to be given some opportunity to that effect. 4. I have also considered the submissions made by learned counsel for the both sides. 5. Since the petitioner is interested in facing the trial, he definitely deserves to be given some opportunity to that effect. 6. Therefore, this anticipatory bail application of the petitioner is allowed. 7. It is hereby directed that the petitioner Arun Maji shall appear before the Court of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati within next 20 (twenty) days from today in respect of PRC Case No.84/2020 and on his appearance he shall be released on bail of Rs.25,000/- with a local surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. 8.
It is also directed that the petitioner shall appear before the Trial Court on each and every date of hearing, if he fails to do so, the Trial Court shall have the
