ORDER:
The Criminal Revision Case has been filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973 (for brevity, ‘the Cr.P.C.’) aggrieved by the judgment dated 30.10.2019 in Crl.A.No.49 of 2016 on the file of learned III Additional District & Sessions Judge, Kurnool, Nandyal confirming the
judgment of conviction and sentence passed on 18.08.2015 in C.C.No.571 of 2014 on the file of the Court of Special Magistrate, Nandyal.
2. Heard the learned Counsel for the Petitioner, the learned Assistant Public Prosecutor and the learned Counsel for Respondent No.2.
3. The learned counsel for the petitioner submits that the matter has been amicably settled between the parties before the Lok Adalat, pursuant to which the petitioner has paid a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to respondent No.2.
5. On careful perusal of the entire facts and circumstances of the case, and taking into account the amicable settlement arrived at between the parties, this Court is of the considered opinion that no purpose would be served in permitting the criminal proceedings to continue. Accordingly, the Criminal Revision Case is disposed of as compromised.
6. Consequently, the judgment dated 30.10.2019 in Crl.A.No.49 of 2016 on the file of learned III Additional District & Sessions Judge, Kurnool, Nandyal confirming the judgment of conviction and sentence passed on 18.08.2015 in C.C.No.571 of 2014 on the file of the Court of Special Magistrate, Nandyal, is hereby set aside. Accordingly, the petitioner is acquitted of the charge under
Section 138 of the Negotiable Instruments Act, 1881, in terms of Section 320(8) of ‘the Cr.P.C’. Both parties, who are present before this Court, have unequivocally undertaken that they shall not initiate any civil or criminal proceedings against each other in respect of the subject dispute in future.
As a sequel, Miscellaneous petitions, if any pending, shall stand closed.
