This first bail application has been moved by the applicant seeking regular bail in Case Crime No.306 of 2024, under Section 137(2), 87, 64(1), B.N.S., 2023 and Section 5/6 of POCSO Act, registered at Police Station I.T.I., District Udham Singh Nagar. 3. Learned counsel for the applicant submits that applicant has falsely been implicated in the instant crime and is languishing in jail since 13.11.2024. It is contended by learned counsel for the applicant that father of the victim in his testimony has stated that, at the time of incident, victim was 18 years old. He submits that victim has also turned hostile. He submits that in case, the applicant is granted bail, he will not misuse the same and will furnish the bail surety as per the satisfaction of this Court. 4. Learned State Counsel has vehemently opposed the prayer for bail. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits of the case, this Court is of the view that applicant deserves bail at this stage. 2026:UHC:638 6. The bail application is allowed. 7. Let the applicant, namely, Nikhil Rahi be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
