1. Heard Mr. S. Nawaz, learned counsel for the petitioner. Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor for the State of Assam.
2. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Prashanta Das @ Papu Das, who is facing trial
Page No.# 2/2 in Sessions (T-1) Case No.19/2026, under Sections 302/34 of the Indian Penal Code, pending in the Court of the learned Sessions Judge, Nagaon has prayed for releasing him on bail.
3. I have considered the submission made by the learned counsel for both sides.
4. In this case, it has been submitted that only 1 (one) witness has been examined till now.
5. Let the Trial Court examine at least 3 (three) witnesses and after that the petitioner shall have the liberty to approach this Court again for seeking regular bail.
6. With the aforesaid direction, the present bail application stands disposed of.
