The applicant has preferred this 2nd bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 02/2025, registered at Police Station – City Kotwali, District- Raigarh (C.G.) for offence punishable under Sections 109, 103(1) and 3(5) of BNS. 4. First bail of the applicant was dismissed on merits vide order dated 14.07.2025 passed in MCRC No.4597/2025. 5. The prosecution story, in short, is that Dilip Kumar Agrawal is the proprietor of Sky King Courier and has rented out a room in his house located near Shiv Mandir, Sonia Nagar, Raigarh. Delivery boys Sachin Pradhan and Sushil Bhoi, who work at the courier service, had been residing in one of the rooms on rent for the past month. On the night of 01/01/2025 at around 11:40 PM, Sachin Pradhan called Dilip Kumar Agrawal on his mobile phone and informed him that a dispute had arisen between the three—himself, Sushil Bhoi, and Kunal Chadimaly —while consuming alcohol, leading to a physical altercation. During the 2 said altercation, Sushil Bhoi, with an intention to kill, struck Kunal Chadimaly on the head with a vegetable-cutting knife. Upon receiving this information, Dilip Kumar Agrawal rushed to the scene. Deepak Chadimaly, uncle of the injured, also arrived at the location with his nephew Ravindra. When they reached the room, they found that the room was locked from inside. Sachin Pradhan was standing outside the room, while Sushil Bhoi was inside. During course of treatment Kunal Chadimaly died. Based on above, offense has been registered against the applicant. 6. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. At the time of incident, the applicant was outside the room. He can be made as witness but the prosecution has made him accused. He further submits that the applicant is in jail since 02.01.2025, out of 26 prosecution witnesses, 20 have been examined till date and the trial is likely to take some more time to be finalized, therefore, it is prayed that the applicant may be enlarged on bail. 7. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that there is no change in circumstances, therefore, looking to the nature of offence, the second bail of the applicant may also be rejected. 8. I have heard learned Counsel appearing for the parties and perused the material available on record. 9. Considering the facts and evidence collected by the prosecution against the applicant and the fact that there is no change in circumstances since first bail, without commenting on merits of the case, I am not inclined to release the applicant on bail. 10. Accordingly, the bail application is rejected. 11.However, looking to the detention period of the applicant, the trial Court is directed to expedite the trial and to ensure that the trial is concluded as early as possible preferably within four months from the date of receipt of copy of this order.
