LEGAL AID 3 SS,J Crl.R.C.No.2131 of 2009 The Court made the following Order: The instant Criminal Revision has been preferred against an order dated 15.05.2009 in M.C.No.221 of 2007 passed by the learned Additional Family Court, Visakhapatnam. The petitioner is husband of respondents. The respondents herein are the petitioners filed M.C.No.221 of 2007 under Section 125 of Cr.P.C. to get maintenance. 2. After hearing the parties, the learned Court below has ordered and allowed the petition, granting maintenance in favour of the 1st respondent (wife) to a tune of Rs.1500/- and Rs.1000/- each per month in favour of the children totaling to Rs.3500/-. 3. Learned counsel for the petitioner submits that the petitioner is a coolie, who used to earn only Rs.70/- per day. Therefore, the maintenance amount is exorbitant for him. Learned counsel for the respondents submits that it has been pleaded before the learned Trial Court that the petitioner has six (06) acres of property. 4. Having heard the entire facts and circumstances and after perusing the impugned order passed by the learned Magistrate, it appears that the order of maintenance granting a total amount of Rs.3500/- as maintenance, that too for three (03) persons, at the present market value, the said amount is a very meager one, and therefore, it cannot be said to be exorbitant one. 4 SS,J Crl.R.C.No.2131 of 2009 5. Accordingly, I find no justification to entertain the petitioner. Thus, this Criminal Revision Case is hereby dismissed as devoid of merit. The petitioner is directed to pay on the maintenance as per the direction of the learned Magistrate. Arrears of maintenance shall be paid to the respondents within three (03) months by three (03) equal installments. 6. Accordingly, this Criminal Revision Case is dismissed.
