JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner has sought for the following reliefs: "(a) CALL for the records which resulted in placing the Petitioner at Sl.No.151 in place of Sl.No.63 in the provisional Seniority List vide Annexure-J and consequently, denying the financial benefits to the Petitioner; (b) ISSUE an order, direction or writ in the nature of MANDAMUS directing the Respondents to re-fix the pay-scale of the Petitioner by treating the Petitioner as deemed to have been appointed with effect from 28.09.2012; - 3 - HC-KAR NC: 2026:KHC:15119 WP No. 7290 of 2026 (c) ISSUE an order, direction or writ in the nature of MANDAMUS directing the Respondents to pay the arrears of salary and other financial benefits by treating the Petitioner as having been appointed to the post of Assistant Professor in the Department of Engineering with effect from 28.09.2012; (d) ISSUE an order, direction or writ in the nature of MANDAMUS directing the Respondents to treat the Petitioner as deemed to have been appointed with effect from 28.09.2012 and consequently assigning the seniority in the post of Assistant Professors as if the Petitioner is appointed on 28.09.2012; (e) ISSUE any other appropriate writ, order or directions as this Hon'ble Court deems fit under the facts and circumstances of the case, in the interest of justice." 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. Learned counsel for the petitioner submits that the present petition may be treated as a representation to the respondents, who may be directed to consider the same and proceed further in accordance with law. It is further submitted - 4 - HC-KAR NC: 2026:KHC:15119 WP No. 7290 of 2026 that the petitioner would submit a fresh/new representation along with necessary documents within a period of one week from today and the respondents may be directed to consider the same and proceed further in accordance with law. 4. Per contra, learned counsel for the respondent submits that if reasonable time is granted, the respondent would consider the representation submitted/ to be submitted by the petitioner and proceed further in accordance with law. 5. In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition directing the present petition to be treated as representation to be considered by the respondents, who shall proceed further and take appropriate decisions/pass appropriate orders in accordance with law within law within a period of one month from the date of receipt of a copy of this order. 6. In addition thereto, the petitioner shall submit one more representation along with relevant documents to the respondents within a period of six weeks from today pursuant to which, the respondents shall consider and pass appropriate orders/take appropriate decision in accordance with law bearing - 5 - HC-KAR NC: 2026:KHC:15119 WP No. 7290 of 2026 in mind the following documents at Annexures - D, E, F, G, H and J. (i) Annexure D - The copy of the Interim order dated 06.03.2013 in WP.No.9340/2013. (ii) Annexure E - The copy of the order dated 18.04.2023 in WP.No.9340/2013. (iii) Annexure G- The copy of the order dated 11.08.2023 passed by the Hon'ble Supreme Court of India in SLP.No.16962/2023. (iv) Annexure H - The copy of the letter of appointment signed by respondent No.2 dated 13.09.2023 appointing the petitioner as Asst.Professor, Agricultural Engineering. (v) Annexure J - The copy of the provisional Seniority list of Assistant Professors of respondent No.1 University dated 18.01.2025.
