... … Opposite Parties
CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR -----
For the Petitioner
: Mr. Manav Poddar, Advocate
For the Opposite Party No. 1 : Mr. Suresh Kumar, SC (L&C)-II -----
15/09.01.2026 The present contempt petition has been filed for initiating a contempt proceeding against the contemnors/opposite parties alleging wilful violation of the order dated 16.10.2023 passed in W.P.(S) No. 5582 of 2019.
2.
A supplementary show cause affidavit has been filed on behalf of the Deputy Commissioner, Sahebganj and the District Education Officer, Sahebganj on 06.12.2025, paragraph nos. 5 and 6 of which read as under:
“5. That in continuation of earlier submissions, it is humbly stated that there is no provision under the applicable rules to pay arrears of revised salary to the petitioner, except the grant of notional benefits for the past period.
6. The Rule IX of Resolution No. 1726 dated 21.06.2022, issued by the Department of School Education & Literacy, Government of Jharkhand, clearly stipulates as follows:
“As a result of promotion to the above pay scale, notional benefits will be payable from the date of promotion and financial benefits will be payable from the date of joining the post. Apart from the pay fixation for the previous period, no other financial benefits will be payable in this regard.”
3. As against this, learned counsel for the petitioner submits that the opposite parties have wrongly denied the arrears of salary to the petitioner.

4.
Be that as it may.
5. Since the payment of admitted claims have already been made to the petitioner in compliance of the aforesaid order of this Court, there is no need to further proceed in the contempt petition. The contempt proceeding as against the opposite parties is hereby dropped.
6. The contempt petition is accordingly disposed of.
7. The petitioner is, however, at liberty to take appropriate recourse as permissible under law for redressal of his grievance.
